§ 1.14.020. Definitions.

  • For the purposes of this chapter, the following definitions apply to these words and phrases:

    "Administrative citation" or "citation" means a written notice to a responsible person that a violation of this code has occurred and an assessment of a civil fine issued by a code enforcement officer.

    "City manager" means the city manager of the city of McFarland or the manager's designee.

    "Continuing violation" means either: (1) a particular violation of the code continuing for more than thirty days without correction or abatement, or (2) a repeated, consecutive violation of the same offense without intervening days.

    "Hearing officer" means the city of McFarland chief of police or his or her designee.

    "Notice of violation" means a written notice to a responsible person that a violation of this code has occurred and a warning that an administrative citation assessing fines will be issued unless the violation is ceased and abated.

    "Officer" means any person authorized to enforce certain provisions of this code. The following officers and employees have the authority to issue administrative citations as civil fines: city manager, police chief, public works director and planning director.

    "Responsible party" means any person or persons that an officer determines are responsible for causing or maintaining a violation of this code. The term "responsible person" includes but is not limited to a property owner, tenant, person with a legal interest in real or personal property, or person in possession or control of real or personal property.
