§ 2.20.040. Classified employees.

  • A.

    The provisions of this chapter shall apply to all employees in the service of the city, except the following:

    1.

    City manager;

    2.

    Chief of police;

    3.

    City attorney;

    4.

    City engineer;

    5.

    Elective officers;

    6.

    Members of elective and appointive boards, commissions and committees;

    7.

    Persons engaged under contract to supply expert, professional, technical or any other service;

    8.

    Part-time employees paid on an hourly basis, including custodians;

    9.

    Emergency or temporary employees who are hired to meet the immediate requirements of an emergency condition, such as extraordinary fire, flood or earthquake which threatens life or property;

    10.

    Volunteer personnel such as volunteer firemen;

    11.

    Employees, other than those listed elsewhere in this section, who are not regularly employed in permanent positions.

    B.

    Those employees not excepted by the foregoing and to which this chapter shall apply, may be referred to as "classified employees" and their position(s) may be referred to as "classified service."

    C.

    The city manager, chief of police, city attorney, city engineer, members of appointive boards, commissions and committees, persons engaged under contract, part-time employees, emergency or temporary employees and voluntary personnel shall all serve at the will of the city council and may, without cause, be demoted, dismissed, discharged or reduced in pay without the right of any appeal or to any hearing.

    D.

    Notwithstanding the foregoing, any part of the personnel rules and regulations adopted by resolution pursuant to the ordinance codified in this chapter and any amendment thereto, may provide for and apply to the city manager and chief of police.
